This website (www.swiftstreetwear.com) is owned and operated by Sparkwright Labs LLC, d/b/a Swift St. ("Swift St.," "we," "us," or "our"). These Terms of Service ("Terms") set forth the terms and conditions under which you may use our website and services (the "Site"). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Who Can Use This Site
You must be at least 18 years of age, or the legal age of majority in your jurisdiction, and possess the legal authority to enter into these Terms in order to use the Site or purchase our products. If you are under this age, you may only use the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
2. Key Commercial Terms
When purchasing an item, you are responsible for reading the full item listing — including sizing, materials, and description — before completing your purchase. Prices listed on the Site are subject to change at any time without notice. We reserve the right to correct pricing errors, including on orders already placed, and will notify you before charging a corrected amount.
Orders enter production shortly after purchase. If you need to cancel or change an order, contact us immediately at jon@sparkwrightlabs.com — we can only guarantee a full refund on a canceled order before production has begun. Once production starts, cancellation may no longer be possible.
3. Shipping and Delivery
Orders are fulfilled through our print-on-demand partner. Estimated delivery times shown on the Site are estimates only and are not guaranteed. Title and risk of loss for products pass to you upon shipment to the carrier. We are not responsible for delays, loss, or damage caused by the shipping carrier once an order has left our fulfillment partner's facility, though we will assist in good faith with claims where possible.
4. Returns and Replacements
All sales are final. We do not offer monetary refunds.
If you receive a damaged, defective, or misprinted product, contact us within 7 days of delivery at [insert support email] with your order number and photos of the issue. Do not return the item until you have received approval and instructions from us — unauthorized returns will not be accepted. Once your claim is approved, we will provide next steps, which may include a replacement of the same product at no additional cost. We do not provide monetary refunds under any circumstances.
Returns are not accepted for items that are worn, washed, altered, or damaged through misuse, nor for orders affected by incorrect shipping or contact information provided at checkout.
If your order does not arrive and tracking shows it as lost in transit, please contact us within 7 days of the estimated delivery date so we can investigate.
5. Warranties
When we receive a valid warranty claim for a product purchased from us, we will, at our discretion, repair the defect or replace the product. We do not provide monetary refunds for any products sold through the Site. Products are provided "as is" except for this limited replacement warranty; we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the maximum extent permitted by law.
6. Intellectual Property
The Site and all materials therein — including software, images, text, logos, designs, trademarks, trade dress, and copyrighted content — are the exclusive property of Swift St. or its licensors. You may not sell, license, modify, reproduce, distribute, or create derivative works from any such content without our prior written consent.
7. Account Suspension and Termination
We may permanently or temporarily terminate or suspend your access to the Site or your account, without notice and without liability, for any reason, including if we determine, in our sole discretion, that you have violated any provision of these Terms.
8. Indemnification
You agree to indemnify and hold Swift St., its owners, employees, and affiliates harmless from any demands, loss, liability, claims, or expenses (including reasonable attorneys' fees) made against them by any third party arising out of or related to your use of the Site or violation of these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Swift St. be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or related to your use of the Site or products purchased through it. Swift St.'s total liability arising out of or related to these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
